Sengketa antara masyarakat Kampung Muara Siram dengan PT. Tegus Swakarsa Sejahtera (PT. Bahwa atas kecurangan PT. TSS maka masyarakat melalui kelompok Supri menunjuk Kuasa Hukum Advokat Yahya Tonang Tongqing melaporkan dugaan tindak pidana Penggelapan lahan dan uang hasil produksi kebun plasma seluas 117 Ha ke Polres Kutai Barat.

“Atas dasar laporan tersebut maka Penyidik Polres Kutai Barat melakukan pemeriksaan saksi-saksi dan pada hari Jum’at tanggal 11 April 2025 melakukan investigasi lapangan mengacu peta eksekusi lahan dalam Berita Acara Eksekusi tanggal 20 Februari 2018 dan ditemukan fakta lahan plasma produktif,” ungkap Yahya Tonang, Minggu ( 13/4/2025).

Bahwa menurut saksi memang lahan plasma yang dieksekusi Pengadilan Negeri Kutai Barat waktu itu merupakan kebun inti, sehingga memang sejak awal lahan produktif dan menghasilkan, makanya saksi menuntut uang plasma sejak tahun 2018 tidak pernah dibayarkan PT. TSS.

Menurut Yahya To yang biasa dijuluki Advokat Master Beruk Kalimantan, seharusnya PT. TSS menghormati Putusan Pengadilan dan BA Eksekusi, bukankah lahan 20% itu memang kewajiban setiap perusahaan perkebunan sawit untuk memberikan kepada Masyarakat bahkan mestinya masyarakat tidak perlu menggugat untuk mendapatkan hak nya itu.

Pemerintah saja menyampaikan jika HGU diperpanjang tahap ke-tiga maka plasma wajib naik jadi 30% jadi tidak mungkin kewajiban 20% ini membuat perusahaan bangkrut. Masyarakat ini sudah benar sejak awal menuntut haknya ke Pengadilan bukan melakukan tindakan anarkis, maka Pengadilan-lah yang menimbang apakah gugatan ini beralasan atau tidak ? ternyata Pengadilan mengabulkan gugatan masyarakat, sampai lahan dieksekusi oleh Pengadilan sendiri, jadi mestinya PT. TSS menghargai putusan wakil Tuhan.

Bahwa lagi menurut Master Beruk, apabila putusan yang sudah incrach dan kemudian objek gugatan telah dieksekusi, maka siapapun yang mengambilnya kembali dari tangan yang berhak dengan dalih apapun tanpa persetujuan seluruh masyarakat dalam CPP itu berati tindak pidana stelionaat dan verduistering, maka Penyidik wajib memproses delik tersebut. Jadi menurut Tonang sambil mengingatkan Polisi jangan hanya laporan Perusahaan saja yang gercep untuk menangkap masyarakat, tapi laporannya ini juga sebagai ujian apakah penyidik juga gercep menangkap perusahaan kalau salah, kan Perusahan itu subjek hukum juga, maka asas equality before the law berlaku.

Untuk diketahui bahwa sengketa antara PT.TSS dan Masyarakat telah dimenangkan masyarakat, bahwa PT. TEGUH SWAKARSA SEJAHTERA (PT. TSS) telah kalah dalam sengketa dalam persidangan mulai dari tingkat Banding, Kasasi dan Peninjauan Kembali (PK) di Mahkamah Agung Republik Indonesia sebagaimana Putusan Mahkamah Agung Nomor 2/Pdt.PK /2017/PN. Sdw Jo Nomor 1436 K/PDT/2016 Jo Nomor 123/PDT/2015/PT. SMR Jo Nomor 20/Pdt.G/2014/PN Sdw. Namun hingga kini masyarakat masih harus berjuang untuk haknya tersebut kata Tonang selaku Kuasa Hukum Supri cs, menutup wawancara.
