Ketua Komisi II Dewan Perwakilan Rakyat Republik Indonesia (DPR RI), Muhammad Rifqinizamy Karsayuda, mengapresiasi langkah yang dilakukan Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional (ATR/BPN) dalam hal pengakuan dan perlindungan hak atas tanah ulayat di Kalimantan Selatan. Menurutnya, langkah tersebut merupakan bentuk nyata komitmen negara dalam memberikan kepastian hukum bagi masyarakat hukum adat.
“Kita bersyukur, di bawah kepemimpinan Pak Nusron Wahid, Kementerian ATR/BPN di Kalimantan Selatan khususnya telah melakukan kerja-kerja yang baik,” ujar Ketua Komisi II DPR RI dalam kegiatan Sosialisasi Pengadministrasian dan Pendaftaran Tanah Ulayat Masyarakat Hukum Adat, yang berlangsung di Kantor Gubernur Kalimantan Selatan, Kamis (31/07/2025).
Ketua Komisi II DPR RI mengungkapkan, hingga saat ini terdapat empat lokasi tanah ulayat yang telah teridentifikasi dan dipetakan oleh Kementerian ATR/BPN di Provinsi Kalimantan Selatan, yakni Kabupaten Kotabaru, Kabupaten Tabalong, Kabupaten Hulu Sungai Selatan, dan Kabupaten Hulu Sungai Tengah.
Meski demikian, ia meyakini masih banyak wilayah lain yang juga memiliki tanah ulayat, namun belum teridentifikasi secara resmi. Oleh karena itu, dalam sosialisasi ini, Muhammad Rifqinizamy Karsayuda, juga mengimbau kepala daerah serta pimpinan DPRD yang hadir untuk ikut bekerja sama memberikan perlindungan hak masyarakat hukum adat.
“Kalau kita bisa lindungi dan kita bisa identifikasi yang mana betul-betul tanah adat dan tanah ulayat, maka insyaallah berbagai macam isu terkait dengan pencaplokan tanah ulayat, tanah adat yang selama ini selalu dialamatkan kepada pihak swasta, para investor dan seterusnya, itu bisa kita mitigasi sejak awal. Perlindungan hukumnya bisa kita pastikan sejak awal,” tegas Muhammad Rifqinizamy Karsayuda.
Menurutnya, isu tanah ulayat sering kali muncul di wilayah yang memiliki potensi ekonomi tinggi, terutama sumber daya alam. Maka dari itu, diperlukan identifikasi yang objektif terhadap keberadaan masyarakat hukum adat dan wilayah adatnya agar perlindungan hukum bisa ditegakkan secara adil dan menyeluruh.
