KANALBORNEO. COM, BALIKPAPAN – Direktorat Reserse Kriminal Khusus (Ditreskrimsus) Polda Kalimantan Timur berhasil mengungkap kasus dugaan tindak pidana penggelapan dokumen penting berupa invoice dan lampiran pembayaran yang mengakibatkan kerugian keuangan bagi salah satu perusahaan kontraktor pertambangan di Kalimantan Timur, Rabu (30/7/2025).
Dilansir dari Tribratanews.Kaltim.Polri.go.id, kasus bermula dari laporan PT. BAR yang merasa dirugikan setelah menyerahkan dokumen tagihan (invoice) asli senilai Rp54 miliar lebih kepada tersangka ADS (44) yang saat itu menjabat sebagai kurator dalam proses kepailitan PT. KS.
Dokumen tersebut diserahkan oleh PT. BAR pada 21 dan 28 September 2020 untuk proses verifikasi piutang. Namun, tersangka diduga tidak mengembalikan dokumen tersebut, bahkan setelah dilakukan perjanjian pengalihan hak tagih (cessie) antara PT. BAR dan PT. LCI yang disepakati pada 15 Desember 2021.
Dalam perjanjian tersebut, PT. LCI membeli hak tagih PT. BAR senilai Rp54.005.054.743 dengan harga Rp30 miliar dan dijanjikan dibayar secara angsuran sebesar Rp1,129 miliar per bulan selama dua tahun. Namun, PT. LCI hanya melakukan tiga kali pembayaran ditambah dana awal, dengan total senilai Rp6.289.102.660, menyisakan kekurangan sebesar Rp23.710.897.340.
Ketika PT. BAR menagih sisa pembayaran, PT. LCI beralasan belum menerima dokumen invoice asli. Padahal, dokumen tersebut sebelumnya telah diserahkan kepada kurator, AGS (44) namun tidak pernah dikembalikan atau diteruskan kepada pihak yang berwenang.
Akibat perbuatan tersebut, PT. BAR mengalami kerugian miliaran rupiah dan kasus ini pun diproses sesuai ketentuan hukum yang berlaku. Tersangka dijerat dengan Pasal 375 KUHP junto Pasal 374, 372, dan 406 ayat (1) KUHPidana terkait dugaan penggelapan dan perusakan atau penghilangan dokumen milik pihak lain secara melawan hukum.
Selanjutnya, tersangka berikut barang bukti telah dilimpahkan ke Jaksa Penuntut Umum di Kejaksaan Tinggi Kalimantan Timur di Samarinda untuk proses hukum lebih lanjut.
Polda Kaltim menegaskan komitmennya dalam menindak tegas segala bentuk kejahatan korporasi dan memberikan kepastian hukum kepada para pelaku usaha yang menjadi korban.
